These Terms of Use (“Terms”, “Agreement”) govern your access to and use of the Timeless Tributes website and services (collectively, the “Site” or “Services”). By using our Site or opening an account, you agree to be bound by these Terms, including any additional terms, conditions, and policies referenced or linked herein. 1.3 Minors

If you are a parent or guardian of a minor creating an account, you accept these Terms on the minor’s behalf and are fully responsible for all use of that account.

2.2 You are solely responsible for maintaining the confidentiality of your login credentials and for all activities under your account.

2.3 You agree to immediately notify Timeless Tributes of any unauthorized use of your account or breach of security.

2.4 Timeless Tributes shall not be liable for any loss or damage arising from your failure to safeguard your account information.

3. CONTENT AND USER CONDUCT

3.1 User Content Responsibilities

You are solely responsible for any and all content, materials, or communications (“Content”) that you upload, post, email, transmit, or otherwise make available through our Site or Services.

You understand that by using our Site, you may encounter Content that you consider offensive, indecent, or objectionable. To the fullest extent permitted by law, Timeless Tributes shall not be liable for any Content posted by users or third parties.

(c) respond to claims of rights violations;
(d) respond to your customer service requests; or
(e) protect the rights, property, or safety of Timeless Tributes, its users, or the public.

4. VIOLATION OF OUR TERMS OF SERVICE

4.1 Consequences of Violation
Violations of these Terms may result in one or more of the following actions:

(a) Deletion of listings or Content

(b) Restrictions on account privileges

(d) Legal action, including civil or criminal proceedings

(e) Claims for damages and/or injunctive relief

5. INTELLECTUAL PROPERTY RIGHTS

5.1 All intellectual property, including text, images, graphics, design elements, and other content on the Site, is owned by or licensed to Timeless Tributes.

5.2 You may not reproduce, distribute, modify, or otherwise use any materials from our Site without our express written consent.

5.3 Users retain ownership of their own submitted Content but grant Timeless Tributes a non-exclusive, worldwide, royalty-free license to use, display, and distribute such Content in connection with our Services.

6. PRIVACY AND DATA PROTECTION

6.1 Your privacy is important to us. The collection, use, and disclosure of personal data are governed by our Privacy Policy, which forms part of these Terms.

6.2 By using our Site, you consent to the processing of your personal data in accordance with the Personal Data Protection Act 2010 (Malaysia).

7. PRODUCT INFORMATION AND PRICING

7.1 We make every effort to display accurate product descriptions, images, and pricing. However, errors may occasionally occur.
7.2 In the event of a pricing or description error, Timeless Tributes reserves the right to correct such errors and cancel any affected orders, even if payment has been processed. A full refund will be issued where applicable.
7.3 All prices are inclusive or exclusive of applicable taxes as stated on the product page.
7.4 Prices and availability are subject to change without prior notice.

8. PURCHASES AND PAYMENTS

8.1 By placing an order, you agree to provide accurate and complete billing information. All prices listed are in Malaysian Ringgit (MYR) unless stated otherwise.

8.2 We accept major payment methods available at checkout.
8.3 Timeless Tributes reserves the right to:

(a) Refuse or cancel any order at our discretion

(b) Verify payment information before processing orders

8.4 If your payment is unsuccessful or unauthorized, we may suspend or cancel your order.

8.5 Currency and Fees
You are responsible for any foreign transaction fees, bank charges, or currency conversion costs incurred through your payment provider.

9. CANCELLATIONS, RETURNS AND REFUNDS

9.1 Each order is handcrafted and customized. As such, we generally do not accept returns or cancellations once production has begun.

Refunds or replacements will only be offered in cases where:

(a) The product received is defective or damaged

(b) There is a significant error in personalization due to our fault

9.2 Please notify us within 3 days of receipt with supporting evidence (e.g., photographs) to request a resolution.

9.3 Refunds will be processed using the same payment method used for the original transaction unless otherwise agreed. Please allow 7–14 business days for processing, depending on your payment provider.

9.4 All refund or replacement approvals are at the sole discretion of Timeless Tributes.

10. DELIVERIES

10.1 We aim to deliver all orders promptly and in good condition. Delivery timelines are estimates and may vary due to factors outside our control (e.g., courier delays, customs, or weather).

10.2 Once an order has been dispatched, Timeless Tributes is not liable for delays, losses, or damages occurring during transit. Risk of loss or damage to the goods passes to you upon delivery to the address provided at checkout

11. THIRD-PARTY LINKS AND SERVICES

11.1 Our Site may contain links to third-party websites or services that are not owned or controlled by Timeless Tributes.

12. DISCLAIMERS

12.2 Timeless Tributes does not guarantee that the Site will be uninterrupted, error-free, or secure, nor that any Content will be accurate or reliable.

12.3 Personalization Disclaimer
Colours, materials, or engravings may appear slightly different from images shown on the Site due to variations in screens or handcrafted processes. Such differences shall not constitute defects or grounds for refunds.

13. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Timeless Tributes shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of or inability to use our Site or Services, even if we have been advised of the possibility of such damages. Our total liability in any circumstance shall not exceed the total amount paid for the relevant order.

14. INDEMNITY

You agree to indemnify and hold harmless Timeless Tributes, its officers, employees, and affiliates from any claims, liabilities, losses, or damages (including legal fees) arising from your breach of these Terms or your misuse of the Site.

15. TERMINATION

Timeless Tributes reserves the right to suspend or terminate your access to the Site or Services at any time, without notice, for any reason, including any violation of these Terms.

16. FORCE MAJEURE

Timeless Tributes shall not be liable for any delay or failure in performance caused by circumstances beyond its reasonable control, including but not limited to natural disasters, acts of God, war, terrorism, government restrictions, strikes, or supply chain disruptions. In such cases, obligations will be suspended for the duration of the event. In such circumstances, Timeless Tributes shall not be liable for any failure to deliver products or perform obligations delayed by these events.

17. GOVERNING LAW AND JURISDICTION

17.1 These Terms shall be governed by and construed in accordance with the laws of Malaysia. Any disputes arising hereunder shall be subject to the exclusive jurisdiction of the courts of Malaysia.

18. MISCELLANEOUS

18.1 If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain valid and enforceable to the fullest extent permitted by law.
18.2 These Terms constitute the entire agreement between you and Timeless Tributes regarding the use of the Site and supersede all prior agreements.
18.3 Failure by Timeless Tributes to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

18.4 By creating an account or providing your contact information, you consent to receive transactional and service-related communications via email, SMS, or other digital means. You may opt out of marketing communications at any time without affecting essential service notifications.

18.5 These Terms are drafted in English. If translated into Bahasa Malaysia or any other language, the English version shall prevail in the event of inconsistency.
